PO'L Handyman & Decorator
These Terms and Conditions apply to all quotations, estimates and work carried out by PO'L Handyman & Decorator ("the Company"). By accepting a quotation, paying a deposit or allowing work to commence, the customer confirms they have read, understood and agree to these Terms and Conditions.
1. Quotations
All quotations are valid for 30 days unless otherwise stated.
Quotations are based on the information available at the time of inspection and the details provided by the customer.
Any hidden defects or unforeseen issues discovered during the work may require additional labour or materials. These will be discussed with the customer before any additional work is carried out.
Any changes requested after work has commenced must be discussed and agreed in writing before the additional work is undertaken. Any agreed changes may incur additional charges and may affect the completion date.
2. Deposits
A deposit may be required to secure your booking and cover the cost of materials.
Deposits are non-refundable where the customer cancels the booking or breaches the agreement, subject to the customer's statutory rights under UK consumer law.
If PO'L Handyman & Decorator is unable to carry out the agreed work, any deposit paid will be refunded in full.
3. Payment
Full payment is due on the day the work is completed.
Payment may be made by bank transfer or cash unless otherwise agreed in writing.
Payment is not conditional upon the customer receiving funds from any third party, including (but not limited to) an insurance company, landlord, letting agent, contractor or property developer.
Failure to pay on the completion date may result in interest and reasonable debt recovery costs being added where permitted by law.
4. Customer Responsibilities
The customer agrees to:
Provide safe and unrestricted access to the property.
Ensure electricity, lighting and running water are available where required.
Remove or adequately protect valuable and fragile items before work begins.
Ensure all rooms and work areas are cleared before work commences.
A charge of £30 per room will apply where rooms have not been cleared and PO'L Handyman & Decorator is required to move furniture or belongings before work can begin.
Obtain any permissions or approvals required before work starts.
5. Decorating Work
Paint colours are chosen by the customer and should be confirmed before work begins.
If the customer changes the chosen paint colour after materials have been purchased or after work has commenced, all additional paint, labour, materials and associated costs will be charged to the customer.
Where the customer requests colour matching, they acknowledge and accept that an exact match cannot be guaranteed. Slight differences in colour may occur due to lighting, existing finishes, manufacturer tolerances and paint batches.
Newly plastered surfaces must be fully dry before decorating unless otherwise agreed.
6. Customer-Supplied Wallpaper
Where wallpaper is supplied by the customer:
PO'L Handyman & Decorator accepts no responsibility for the quality, manufacture, print quality, colour consistency or suitability of the wallpaper.
Some wallpaper, particularly lower-cost products, may contain manufacturing defects, colour variation, stretching or pattern mismatches.
PO'L Handyman & Decorator cannot be held responsible for pattern mismatches or imperfections caused by the manufacture or quality of customer-supplied wallpaper.
Additional labour required due to defective wallpaper, damaged rolls, missing rolls or manufacturing faults will be charged separately.
7. Customer-Supplied Materials and Handyman Installations
Where the customer supplies fixtures, fittings, furniture, appliances, paint, wallpaper or any other materials:
PO'L Handyman & Decorator is responsible only for carrying out the installation or decorating work with reasonable care and skill.
The Company accepts no responsibility for manufacturing defects, missing parts, poor-quality products, unsuitable materials or product failure.
Additional labour required due to defective, damaged, incomplete or unsuitable customer-supplied products or materials will be charged accordingly.
8. Additional Work
Any work outside the original quotation must be discussed, agreed in writing, and approved before it is undertaken. Additional work will be charged separately.
9. Delays
The Company shall not be responsible for delays caused by:
- Adverse weather.
- Supplier shortages.
- Customer-requested changes.
- Restricted property access.
- Illness.
- Circumstances beyond our reasonable control.
- Completion dates may be revised where such delays occur.
10. Parking and Access
Where parking charges, permits or congestion charges apply, these costs will be the responsibility of the customer unless otherwise agreed.
Safe and reasonable access to the property must be maintained throughout the project.
Delays caused by restricted access may result in additional charges.
11. Working Hours
PO'L Handyman & Decorator will normally work between 8:00am and 5:00pm, Monday to Friday, however working hours are entirely at the Company's discretion.
Working days may be shorter or longer depending on workload, weather conditions, drying times, property access and the stage of the project.
The Company is not obliged to work a minimum number of hours each day, provided the work is carried out with reasonable care and skill and completed within a reasonable timeframe.
Weekend or evening work may be undertaken where appropriate.
12. Waste Disposal
Waste removal is only included where specifically stated within the quotation.
Any additional waste removal requested by the customer may incur an additional charge.
13. Workmanship Guarantee
PO'L Handyman & Decorator guarantees its workmanship for 12 months from the completion date.
This guarantee covers workmanship only and does not cover:
- Normal wear and tear.
- Accidental or deliberate damage.
- Structural movement.
- Damp, leaks or condensation.
- Defective customer-supplied materials.
- Manufacturer defects.
- Damage caused by third parties.
14. Pre-Existing Defects
PO'L Handyman & Decorator cannot be held responsible for defects or issues caused by the existing condition of the property or previous workmanship.
This includes, but is not limited to:
- Damp, mould or condensation.
- Water leaks or water damage.
- Cracked, loose or damaged plaster.
- Peeling paint caused by previous coatings or poor preparation.
- Structural movement or settlement.
- Poor workmanship carried out by previous contractors.
- Hidden defects that become apparent during preparation or after decorating.
- Existing stains or discolouration bleeding through previously decorated surfaces.
Where pre-existing defects are discovered before or during the work, the customer will be informed as soon as reasonably practicable. Any remedial work required is not included in the original quotation unless specifically stated and will be quoted separately.
PO'L Handyman & Decorator cannot guarantee the longevity or appearance of decorative finishes where underlying defects remain untreated or where the customer chooses not to proceed with recommended remedial work.
15. Cancellations
Deposits remain non-refundable where the customer cancels or breaches the agreement, subject to statutory consumer rights.
Where materials have already been purchased or costs have been incurred specifically for the customer's project, those reasonable costs may also be payable by the customer.
16. Ownership of Materials
All materials supplied by PO'L Handyman & Decorator remain the property of the Company until payment has been received in full.
17. Photography
Unless the customer requests otherwise in writing before work commences, PO'L Handyman & Decorator reserves the right to photograph completed work for use on its website, social media pages and other promotional material.
Photographs will not intentionally include personal possessions, family members or identifying information.
18. Insurance
PO'L Handyman & Decorator maintains appropriate Public Liability Insurance.
Proof of insurance is available upon request.
19. Right to Suspend or Stop Work
PO'L Handyman & Decorator reserves the right to suspend or stop work immediately where:
The working environment is unsafe.
The Company or its representatives are subjected to abusive, threatening or inappropriate behaviour.
Payment terms are breached.
The customer prevents work from being completed as agreed.
Circumstances arise that make it unreasonable or unsafe to continue.
Any delays or additional costs resulting from suspension of work under these circumstances may be charged to the customer.
20. Customer Acceptance on Completion
Upon completion of the work, the customer (or their representative) will be given a reasonable opportunity to inspect the work.
Any visible defects or concerns should be raised as soon as reasonably possible and, where practical, before final payment is made.
Minor snagging items that do not materially affect the overall quality or usability of the work do not entitle the customer to withhold payment.
PO'L Handyman & Decorator will rectify any genuine workmanship defects covered by the workmanship guarantee within a reasonable timeframe.
21. Liability
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.
Subject to the above, PO'L Handyman & Decorator's liability for any claim arising from the services provided shall not exceed the total amount paid by the customer for the work concerned.
The Company shall not be liable for indirect or consequential losses.
22. Non-Payment
Failure to make payment by the agreed due date may result in:
Interest being charged where permitted by law.
Recovery of reasonable debt collection and legal costs.
Suspension or refusal of future work.
Legal action where necessary to recover outstanding amounts.
23. Acceptance of Terms
Acceptance of a quotation, payment of a deposit or allowing work to commence shall be deemed acceptance of these Terms and Conditions.
These Terms and Conditions form part of every quotation and contract issued by PO'L Handyman & Decorator.
24. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
